These Terms and Conditions (the “Agreement”) apply when ordering online from Pizza Bytes Redcar Ltd (“Restaurant”, “we”, “us” or “our”).

By using our website (the “Site”), you agree to this Agreement and any additional terms we make available on the Site (collectively, the “Terms”). If you do not agree, please do not use the Site.

1. Eligibility & Acceptance

By using the Site, you confirm you are of legal age to enter into this Agreement. If you access the Site on behalf of an organisation, you represent you have authority to bind that organisation, and “you” includes both you and that organisation.

2. Changes to These Terms

We may update these Terms at any time by posting a revised version on the Site. Changes do not apply to disputes that arose before the revised Terms were posted. Continued use of the Site after changes means you accept the updated Terms.

3. Privacy

Your use of the Site is subject to our Privacy Policy (see link above). You represent that any information you provide is accurate and will be kept up to date.

4. Jurisdictional Issues

The Site is controlled from the United Kingdom and may not be appropriate in all jurisdictions. You are responsible for compliance with applicable laws.

5. Rules of Conduct

You agree not to:

Post unlawful, defamatory, harassing, hateful, obscene, infringing, or otherwise objectionable content.
Upload or distribute malware or other harmful code.
Interfere with the Site’s operation or attempt to gain unauthorised access.
Harvest user data without consent.
Copy, reverse engineer, scrape, frame, mirror, or otherwise exploit the Site except as expressly permitted by these Terms or applicable law.

You are responsible for obtaining and maintaining all devices and services needed to access the Site.

6. Products, Allergens & Information

We may display menus, product descriptions, images, prices, and dietary information (“Products”). While we aim for accuracy, information may change without notice and may not always be complete or up to date. Images are illustrative only. If you have food allergies or dietary requirements, contact us directly before ordering. We cannot guarantee any Product is free from allergens or meets dietary requirements (including vegetarian, vegan, or gluten-free).

7. Orders, Transactions & Pricing

Placing an order (“Transaction”) may require providing payment and delivery details. You warrant that you have the right to use any payment method submitted and authorise us to share details with third parties to process the Transaction. We may refuse, limit, or cancel any order, apply conditions to promotions, or discontinue Products without notice.
Orders cannot be cancelled once placed. Refunds/exchanges follow our applicable policies. Online prices may differ from in-store or telephone prices. You agree to pay all charges, including delivery fees and applicable taxes, at the rates in effect at the time of ordering. Email confirmations do not constitute acceptance of your order.

8. Delivery & Collection

Orders are subject to our operating hours, delivery areas, and minimum order values. Delivery is to the main entrance of the delivery address, unless both you and the driver agree otherwise. Risk of loss passes upon delivery to the carrier or upon collection.
We aim to meet requested times but cannot guarantee delivery/collection times (e.g., due to weather, traffic, or safety). If you are not present at the agreed time/place, you may be charged in full and no refund will be due.

9. Registration & Account Security

You may need an account to use parts of the Site. We may reject or require changes to your username or password. Keep your credentials confidential and notify us of any unauthorised use. You are responsible for all activity under your account.

10. User Submissions

If you submit content (“Submissions”), you grant us a worldwide, royalty-free, perpetual, transferable, sublicensable licence to use, reproduce, modify, display, distribute, and create derivative works from such Submissions for any purpose (including promotional uses). You warrant you have all rights necessary for your Submissions and waive any moral rights to the extent permitted by law.

11. Monitoring

We may, but are not obligated to, monitor, edit, remove, and disclose Submissions or usage information to operate the Site or comply with law.

12. Intellectual Property

We and our licensors own the Site and its contents. Our trade names, trademarks, service marks, and logos may not be used without our prior written consent. Third-party marks belong to their respective owners.

13. Third-Party Materials & Links

The Site may reference or link to third-party materials. We do not endorse or control such materials and are not responsible for them. Your use of third-party materials is at your own risk and may be subject to third-party terms.

14. Promotions

Any promotions (e.g., contests, raffles, or surveys) may have separate rules. If those rules conflict with these Terms, the promotion rules will govern.

15. Spin Wheel & Fun Games Terms

From time to time, we may offer a promotional Spin Wheel or other games (collectively, “Games”). By placing an order on our Site and/or participating in any Game, you agree to the following:

Eligibility & Earning Spins

Spins may be offered to customers who place qualifying orders on our Site.
The qualifying spend threshold (if any) and any other earning methods (e.g., limited-time tasks or promotions) will be stated on the Site or promotional materials and may change without notice.
Spins are promotional, have no cash value, and cannot be sold, transferred, or exchanged.

How Spins Work

Available prizes and any restrictions will be shown in the Game interface or announcement.
A spin’s outcome is final when displayed by the Game. Screenshots or recordings are not proof of entitlement.

Prizes & Fulfilment

We may substitute a prize with an item of equal or greater value if the original prize is unavailable.
No cash alternatives unless expressly stated.
Prizes may have redemption steps, time limits, or eligibility requirements (e.g., account verification, order collection). Failure to meet these may void the prize.
We may require reasonable proof of identity or order details to award prizes.

Abuse, Fraud & Misuse

We may suspend or terminate participation and/or withhold or cancel prizes if we suspect fraud, abuse, automated participation, tampering, or violation of these Terms.
We may ban accounts or users immediately and without notice for suspected misuse.

Changes & Availability

We may modify, pause, or discontinue any Game (including the Spin Wheel), prize, earning method, or thresholds at any time without notice.
Management decisions are final and not subject to review or appeal.

Liability

To the fullest extent permitted by law, we are not liable for any loss, delay, or failure relating to Games (including technical faults, connectivity issues, or third-party services).

Data & Privacy

We process personal data in line with our Privacy Policy. We may publish anonymised winner information where required by law or for reasonable promotional purposes (you may opt-out where the law permits).

16. Disclaimer of Warranties

To the fullest extent permitted by law, the Site, Products, Third-Party Materials, and Games are provided “as is” without warranties of any kind (express or implied), including merchantability, fitness for purpose, non-infringement, accuracy, or availability. We do not warrant timely deliveries or uninterrupted access.

17. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; data or profit loss; security breaches; or viruses. Your sole remedy for dissatisfaction is to stop using the Site. Our total liability for any claim shall not exceed the total amount you paid to us for the order giving rise to the claim.

18. Indemnity

You agree to defend, indemnify, and hold harmless Pizza Bytes Redcar Ltd and our affiliates, officers, employees, and agents from claims, losses, liabilities, damages, costs, and expenses (including legal fees) arising from your use of the Site, Products, Submissions, Games, or your breach of these Terms.

19. Termination

We may suspend or terminate your access at any time for any reason. Upon termination, your right to use the Site ceases immediately. Sections that by their nature should survive (including 2–3, 6–8, 10–22) will survive termination.

20. Governing Law & Jurisdiction

This Agreement is governed by the laws of England and Wales. You agree to the exclusive jurisdiction of the courts of England and Wales, and waive any objection to venue or inconvenient forum.

21. Filtering

Parental control tools are commercially available (see: https://en.wikipedia.org/wiki/Comparison_of_content-control_software_and_providers). We do not endorse any providers.

23. Miscellaneous

Nothing in these Terms creates an agency, partnership, or joint venture. If any provision is invalid, the remainder remains enforceable. You may not assign your rights without our consent; we may assign freely. No waiver is a continuing waiver. Headings are for convenience only. “Including” means “including without limitation.” These Terms are the entire agreement regarding the Site and supersede prior agreements. A printed copy of these Terms is admissible in legal proceedings. We are not responsible for events beyond our reasonable control. Our affiliates are intended third-party beneficiaries of the limitations and disclaimers herein.
